What is a Limited Recourse Borrowing Arrangement (LRBA)?
An LRBA is the legally mandated structure for an SMSF to borrow money. It ensures that if the SMSF defaults on the loan, the lender's recourse is limited only to the asset purchased (held in the Bare Trust), protecting the other assets within the SMSF from seizure.
Can I use an SMSF loan to buy a residential property for my daughter to live in?
No. SMSF investment properties cannot be acquired from, sold to, or rented by fund members or any related parties. This is a strict "in-house asset" and "sole purpose test" rule violation that can lead to severe penalties from the ATO.
What assets are eligible for an LRBA loan?
Eligible assets are typically real property (residential and commercial) and sometimes single, divisible assets (e.g., a portfolio of identical shares purchased as a single unit). The SMSF must be able to use the loan to acquire a single acquirable asset.
Do I need a personal guarantee for an SMSF loan?
Yes. While the loan is "limited recourse" against the SMSF's assets, PM Finance typically requires personal guarantees from the SMSF trustees. This is necessary because the lender needs assurance that the trustees will manage the fund's obligations responsibly, even though the security is limited to the asset.
What LVR (Loan-to-Value Ratio) can I expect for an SMSF property loan?
Due to the complexity and regulatory risk, LVRs for SMSF loans are generally conservative, typically ranging from 60% to 70% for residential property and slightly lower for commercial property. This means the SMSF must provide a substantial deposit.
